Terms and Conditions
Information on using the website and Drivepoint's commercial services.
This English version is a translation for convenience. The Romanian version prevails.
1. General information
These terms and conditions govern the use of the website drivepoint.ro and the general framework in which Drivepoint provides commercial services in the car trade: sale of used vehicles from stock, vehicle sourcing and import, buy-back, trade-in, consignment, financing support and warranties.
The website presents our services and receives requests. The specific terms of each transaction (vehicle, price, payment, handover, warranty) are set in the individual offer and in the contract signed by the parties. Where a signed contract differs from these terms, the contract applies, without affecting the rights the law grants consumers.

3. Definitions
- Drivepoint, we: CIUK VERKAUF SRL, which operates the Drivepoint brand
- Customer: the individual or company that asks for information or an offer, or concludes a transaction with Drivepoint
- Consumer: an individual acting for purposes outside their trade, business, craft or profession
- Business customer (B2B): a company or self-employed person acting for the purposes of their business
- Offer: Drivepoint's individual written proposal to a customer for a given transaction
- Contract: the document signed by the parties that sets the binding terms of the transaction
4. Information on the website
For each vehicle we show the information available when it is published: make, model, year, mileage, engine, equipment, price, photos, the chassis number (VIN) and, where available, the known history or a history report.
We aim to keep this information accurate and up to date, but drafting errors or differences from the actual condition may occur. Photos are for presentation. Condition, equipment, price and availability are confirmed by Drivepoint before the contract is concluded, and the customer can see the vehicle and its documents before signing.
Listings, payment simulations and calculation examples on the website are for information only. They are not a binding offer in the legal sense.
5. Prices, VAT and the value of the transaction
5.1. How prices are shown
Each vehicle's price is shown in its listing, in EUR. Payment is made in EUR or, on request, in lei at the BNR (National Bank of Romania) rate on the day of payment; in some cases the BNR rate + 1% may apply, as stated in the offer and the contract.
5.2. VAT treatment
Each listing shows the vehicle's VAT treatment: “VAT deductible”, where VAT is shown on the invoice and can be deducted by buyers entitled to do so, or “VAT included, not deductible”, where the sale is made under the special scheme for second-hand goods (the margin scheme) and VAT is not shown separately on the invoice. The applicable treatment is confirmed in the offer and on the invoice.
5.3. Final price
The final price, currency, payment method and payment terms are set in the individual offer and in the contract. Until the contract is signed, the listed price may change and the vehicle may be sold to another customer.
5.4. The trade-in difference
In a trade-in, the amount to pay is the price of the chosen vehicle minus the agreed value of the customer's vehicle. Examples on the website are illustrative. The VAT treatment of each of the two vehicles can affect the calculation, especially for business customers, and is explained in the offer.
5.5. Additional costs
Costs not included in the vehicle price (for example transport, registration, import, extended warranty or other services) are communicated separately, before the contract, in the individual offer. We do not apply costs that have not been communicated to and accepted by the customer.
5.6. When an offer becomes binding
An offer becomes binding on the parties only once it is accepted in writing and the contract (or, where applicable, the reservation contract) is signed. The contract must confirm at least: the vehicle identified by its VIN, the price and VAT treatment, any deposit, the payment terms, the date and place of handover and the applicable warranty.
6. Buying a vehicle
6.1. The steps of a purchase
- the customer's request, through the website, by phone, e-mail or WhatsApp
- Drivepoint's offer and confirmation that the vehicle is available
- a viewing of the vehicle and its documents, if the customer wishes
- a reservation, if the parties agree, by reservation contract: the reservation fee is paid by bank transfer, within one working day of signing, and is deducted from the final price; the length of the reservation is set in the contract, in calendar days from confirmation of payment. If the customer withdraws for reasons attributable to them, Drivepoint keeps the fee; if the sale can no longer go ahead through Drivepoint's fault, the fee is refunded in full within 3 working days
- the sale contract, payment and invoice
- handover of the vehicle, with a handover report
6.2. Consumers and business customers
Consumer rights under the law (in particular the legal guarantee of conformity, pre-contractual information and, where applicable, the right of withdrawal) apply only to transactions with consumers and cannot be limited by contract. For business customers (B2B), terms are set by contract, within the limits of the law.
Contracts can be signed by hand or with an electronic signature, including at a distance. If a contract with a consumer is concluded entirely at a distance, without the parties being physically present together, the consumer has the 14-day right of withdrawal under Government Emergency Ordinance 34/2014, on its terms. Withdrawal is notified in writing, at office@drivepoint.ro.
7. Vehicle sourcing and import
For vehicles sourced to order, Drivepoint searches for a vehicle matching the customer's criteria (model, budget, equipment, year, mileage), checks the information available and presents the options found.
An order becomes binding only once the offer for an identified vehicle is confirmed in writing and the contract is signed. Any deposit, estimated delivery times, transport and import costs, and the conditions for refunding the deposit are set in the individual offer and the contract.
Drivepoint does not guarantee that a given vehicle is available before the seller abroad confirms it, nor that a complete history exists for every vehicle. We check the information that can be obtained (for example the history available by VIN, service records, inspection reports) and tell the customer what could be verified.
8. Buy-back (direct purchase)
With buy-back, Drivepoint buys the customer's vehicle directly. The customer sends the vehicle's details; Drivepoint values it by its specification, condition, available history and market prices, and decides whether it can make a purchase offer.
The valuation is free and does not commit the customer. If the offer is accepted, the parties sign the sale contract, ownership passes on the date set in the contract, and payment is made by bank transfer on the agreed terms. The seller must present the vehicle documents and confirm that the information provided is accurate.
We buy vehicles made from 2019 onwards, with at most 180,000 km. Payment is made within 24–48 hours of signing. Vehicles with a lease or loan running can be bought only once the position with the lender is clear.
9. Trade-in
With a trade-in, the value of the customer's current vehicle goes towards a vehicle from Drivepoint's stock or one sourced to order. Drivepoint values the customer's vehicle, the parties agree its value, the customer chooses the new vehicle and the difference is calculated as in section 5.4.
If the current vehicle is financed by lease or loan, the transaction needs the lender's consent and the closing or transfer of the financing, on the lender's terms. The outstanding balance and the steps required are reviewed before the offer.
The customer does not have to accept the proposed value and can buy the chosen vehicle without a trade-in.
10. Car consignment
With consignment, Drivepoint sells the owner's vehicle to an end buyer, under a consignment contract.
For consignment, the vehicle must be handed over to the Drivepoint car lot for the duration of the contract. Handover is a condition of the service, not an option.
The consignment contract provides, among other things, for:
- a term of 3 months from signing, extendable by written agreement of the parties
- handover of the vehicle at Drivepoint's premises, with a handover sheet recording mileage, documents, keys and condition
- use of the vehicle only for test drives (supervised by Drivepoint), presentation, photography, technical checks and the trips needed for the sale, not for personal use
- promotion of the offer on drivepoint.ro, on Autovit, on social media and on other car platforms
- the cost of the services (preparation and detailing, photos, promotion), stated in the contract
- the initial promotion price and Drivepoint's commission, due only if the sale is completed through Drivepoint's work
- insurance: the owner keeps motor liability (RCA) and CASCO cover valid for the duration of the contract, and Drivepoint is liable for direct, proven damage caused through its own fault
- withdrawal of the vehicle by the owner, with written notice at least 5 days in advance and payment of the approved costs already incurred
- settlement with the owner once the buyer's price has been received in full
11. Financing and leasing
Drivepoint helps customers access financing (finance lease, car loan, other forms of financing) through partner financial institutions: with the customer's consent it passes on the request and helps with the paperwork.
Approval, down payment, instalment, interest rate, fees and other terms are set solely by the lender, under its own criteria. Drivepoint does not grant credit and does not guarantee approval.
Payment simulations on the website are illustrative, calculated with general parameters, and are not binding financing offers. Drivepoint works with the partner banks and leasing companies shown on the Financing page.
12. Warranties and conformity
12.1. Legal guarantee of conformity
For vehicles sold to consumers, Drivepoint is liable for lack of conformity under Government Emergency Ordinance 140/2021. For second-hand goods, the law allows the parties to agree a shorter liability period, but not less than one year. Drivepoint offers a minimum of 12 months.
12.2. Included commercial warranty
Eligible vehicles in stock come with a 12-month Standard commercial warranty included in the price, through the DEFEND Car Protect product (issued by Defend Insurance Group and insured by Fortegra Europe Insurance Company).
12.3. Optional commercial packages
The warranty can be extended, at extra cost, to 24 or 36 months with the Standard, Extended or Premium packages, depending on the vehicle's age and mileage. The price is given before signing.
12.4. Manufacturer's warranty
If the vehicle is still under the manufacturer's warranty, that warranty continues on the manufacturer's terms.
12.5. Please note
Commercial warranties do not replace or limit the consumer's legal rights. The actual conditions, exclusions, claim limits and claim procedure are those in the warranty certificate and terms handed over with the vehicle. Used vehicles may show normal wear for their age, mileage and use.
13. Handover and delivery
The vehicle is handed over at Drivepoint's office or car lot, or at another place agreed in the contract, with a handover report recording its condition, mileage and the documents and keys handed over.
14. Complaints and dispute resolution
Complaints can be sent to office@drivepoint.ro, by phone on +40 727 745 195 or by post to the registered office. We review them and reply in writing, within 30 days of receipt.
Consumers can contact the National Authority for Consumer Protection (ANPC): anpc.ro.
For alternative dispute resolution (ADR/SAL), consumers can use the ANPC platform: reclamatiisal.anpc.ro.
If a dispute cannot be settled amicably, it falls under the jurisdiction of the Romanian courts, as provided by law. For consumers, the jurisdiction rules the law provides in their favour apply.
15. Use of the website
Users must use the website lawfully and fairly: send accurate information through the forms, not attempt unauthorised access to the systems and not use the website for fraudulent purposes or in ways that affect its operation. The forms are protected against automated submissions.
Sending a request does not oblige Drivepoint to make an offer, reserve a vehicle or conclude a transaction. To reply, Drivepoint may contact the sender by phone, e-mail or WhatsApp. The data sent is processed as described in the Privacy Policy.
The website content (texts, photos, graphics, logo) belongs to CIUK VERKAUF SRL or its partners and may not be copied or used without written consent, except where the law allows.
16. External services
Where relevant, the website links to external services: partner financial institutions, WhatsApp, social networks, Google (reviews and directions), OpenStreetMap (map), the ANPC ADR platform. These services have their own terms and policies, for which Drivepoint is not responsible.
17. Liability
Drivepoint is liable for the obligations it takes on by contract and by law. It is not liable for temporary website outages, display errors corrected before the contract, or decisions made solely on online information without confirming it before signing.
Nothing in these terms limits or excludes the rights the law grants consumers, or any liability that cannot be limited by law.
18. Changes and contact
We may update these terms when our services or the law change. The version in force is the one published on this page, with the date and version shown at the top. Transactions already concluded remain governed by the signed contract.
